✅ By placing an order, the Buyer confirms that they have read, understood and fully agree to all the terms and conditions set out in this document.

📘 1. Definitions

👤 Customer/Buyer — a natural or legal person who purchases goods from the ROSES.EE online store.

💳 Orderer — a person who has placed and paid for an order on the ROSES.EE website.

🎁 Recipient — a person to whom the goods are delivered.

🏢 Seller — ONE Management OÜ, a legal entity that sells goods on the ROSES.EE website.

🚗 Courier — a person authorised by the ROSES.EE store to deliver orders.

📞 Company employees contact the customer or recipient exclusively via Estonian telephone numbers beginning with the international code +372 and do not use messengers (WhatsApp, Viber, Telegram and similar services).

🚚 2. Delivery

📅 Deliveries are made daily throughout Estonia.

ℹ️ The seller has the right to set a different delivery schedule at its discretion without prior notice to the buyer. Up-to-date information is published on the ROSES.EE website.

⏱ The seller reserves the right to change the delivery time by up to 90 minutes.

🕓 When placing an order, a delivery time slot is selected, which cannot be changed without the seller’s consent.

⏳ The courier will wait for the recipient for 5 minutes and attempt to contact them by all available means.

👥 If the recipient is not present, the courier may, if possible, hand over the order to a third party.

🏪 Undelivered orders are returned to the pick-up point at the following address:

Tartu Road 24, Tallinn,

where they are stored for 24 hours before disposal.

📩 In the event of an unsuccessful delivery attempt, a notification of the undelivered order is sent to the Customer’s email address provided when placing the order, and the recipient may be sent an SMS message (if a phone number is available).

⚠️ The seller does not guarantee the delivery of notifications.

💶 A fee of €10 is charged for redelivery.

🚫 If delivery was free of charge but did not take place due to the recipient’s fault (incorrect address, absence, unavailable telephone number, etc.),

— redelivery within Tallinn costs €10,

— outside Tallinn — from €10.

🕘 When ordering interval or exact delivery, the Customer guarantees the presence of the recipient during the entire selected time interval.

📍 The Customer is fully responsible for the accuracy of the delivery details provided, including the town, street, house number, recipient’s first and last name, and other information necessary for correct delivery.

🗺 The courier uses Google Maps to determine the location of the delivery address and to plan the delivery route. ROSES.EE treats the location displayed in Google Maps as the primary basis for identifying the delivery address, unless the customer has provided additional precise instructions for finding the delivery location. The customer is responsible for ensuring that the delivery address provided is correct, complete and clearly identifiable in Google Maps. Where necessary, the customer must provide additional instructions, such as the entrance, staircase, floor, door code, landmark or any other access-related information. If the address cannot be clearly identified based on Google Maps and the information provided by the customer, the delivery may be delayed, rescheduled or considered impossible to complete.

🗣 The courier will identify the recipient verbally, without requiring proof of identity.

⚖️ The seller is not responsible for the consequences of incorrect identification of the recipient.

🔒 3. Communication regarding claims

In order to comply with confidentiality and personal data protection (GDPR), all claims and questions regarding the fulfilment of the order are considered exclusively with the Customer — the person who placed and paid for the order.

The recipient is not a party to the contract. Their requests may be taken into account, but are not considered grounds for a refund, compensation or re-fulfilment of the order.

🚫 4. Refusal of delivery at the customer’s initiative

After placing an order and selecting a delivery method, any changes are only possible with the agreement of ROSES.EE.

If the customer refuses the paid delivery service and picks up the order themselves, the delivery cost is not refundable, as the store has fulfilled its obligations to prepare the goods for transfer.

📲 5. SMS and e-mail notifications about delivery status

📱 The recipient will receive an SMS notification about the courier’s departure and delivery of the order on the current route.

📩 In case of an unsuccessful delivery attempt, the recipient may receive an SMS notification about the undelivered order (if a phone number is available).

📧 After delivery or an unsuccessful delivery attempt, the customer receives an e-mail notification about the order status.

⚠️ The seller does not guarantee 100% delivery of notifications, as this depends on the work of mobile operators, postal services and the recipient’s settings.

🏬 6. Pick-up points and self-pick-up

📍 Self-pick-up is possible at Tartu Road 24, as well as at other pick-up points throughout Estonia.

✅ Receipt of the order is considered confirmation of receipt of the goods without complaint.

❌ If the customer has previously submitted a request to cancel the order but has received the order, such receipt automatically cancels the request.

⏳ The storage period for goods at all pick-up points is no more than 24 hours.

🧊 At pick-up points, with the exception of Tartu Road 24, goods are stored without special refrigeration equipment, which may affect the quality and longevity of the flowers.

📌 6.1. Incorrect handover or acceptance of a different item

If, when handing over the order, the Recipient is given a bouquet, arrangement or other item that differs from the order originally placed, and the Recipient accepts such item, signs for its receipt or otherwise confirms receipt, such receipt is considered confirmation of the actual handover of the item.

The Orderer must notify ROSES.EE of the discrepancy between the received item and the order within 12 hours from the actual handover of the item to the Recipient.

The claim must be sent by the Orderer to the ROSES.EE e-mail address, indicating the order number, describing the discrepancy and, where possible, attaching a photo of the received item.

If the claim is not submitted within 12 hours from receipt of the item, the item is considered accepted, and no redelivery, bouquet replacement or re-fulfilment of the order will be carried out.

In the event of a confirmed discrepancy with the order, ROSES.EE may, at its discretion, offer to compensate the price difference if the item actually handed over was cheaper than the item paid for.

If the item actually handed over was equal in value to or more expensive than the paid order, no additional compensation will be provided by ROSES.EE. At the same time, neither the Orderer nor the Recipient is obliged to pay any price difference to ROSES.EE.

After 12 hours have passed from receipt of the item, ROSES.EE will not carry out redelivery or bouquet replacement.

💳 7. Payment and orders

💯 All orders are accepted exclusively with 100% prepayment.

🏦 Orders are fulfilled after payment is received in the Seller’s account.

⏱ Unpaid orders are held for 2 hours after the specified pick-up time, after which they are cancelled.

📝 Comments and requests specified by the Buyer when placing an order are for informational purposes only and are not binding unless expressly agreed with the Seller in writing.

🛒 7.1. Nature of the online store and automated order processing

ROSES.EE is an online store for flowers, gifts and related goods.

When placing an order on the website, the Buyer independently selects the goods, delivery services, additional options, cards, packaging and other goods or services.

After the order is placed, it is assigned a unique number. Further internal processing of the order is carried out mainly on the basis of the order number, the composition of the goods and the technical data necessary for assembling, handing over and delivering the order.

ROSES.EE processes the order based on the information provided by the Buyer and is not obliged to additionally verify the purpose of the purchase, the content of the order, the Buyer’s tax status, the economic rationale of the purchase, or the necessity of purchasing specific goods and services.

Order placement, selection of goods, delivery method, additional services and payment confirmation take place automatically through the ROSES.EE website.

The Buyer is responsible for the correctness of the selected goods, services, delivery details, and for ensuring that the purchase corresponds to their personal, commercial, accounting or tax purposes.

📦 7.2. Division of order processing stages and no assessment of purchase rationale

Order processing at ROSES.EE is organized in separate stages.

Each employee performs only their assigned part of the process:

• the picker compiles the goods according to the order details;
• the florist prepares the bouquet or floral arrangement;
• the administrator processes the order and assigns it for fulfilment;
• the courier delivers the order to the specified address.

At each stage, the employee has access only to the information necessary to perform their specific task. Employees do not additionally verify the purpose of the order, the relationship between the Customer and the Recipient, the tax or accounting grounds of the purchase, or the necessity of purchasing specific goods or services.

ROSES.EE does not perform any analytical, logical, tax, accounting or other assessment of the order content, including whether the composition of the order is usual, unusual, economically reasonable, logical or illogical for a particular Buyer or Recipient.

This approach is applied to protect the rights of the Buyer and the Recipient, including the right to privacy, confidentiality of the purchase, protection of personal data, and freedom to independently choose goods and services.

The Buyer independently selects the goods, additional services, cards, packaging, delivery and other items included in the order. ROSES.EE fulfils the order based on the information provided by the Buyer when placing the order on the website.

Until the actual handover of the order to the Recipient, ROSES.EE does not carry out separate manual supervision of the complete list of goods to be handed over to a specific Recipient, unless such supervision is necessary for order fulfilment, error prevention, compliance with law or review of a claim.

The actual handover of the order is carried out by the courier or pick-up point employee based on the information specified in the order.

The Buyer is responsible for the correctness of the selected goods, additional services, delivery details, and for ensuring that the purchase corresponds to their personal, commercial, accounting or tax purposes.

🔁 8. Order cancellation and refunds

🌸 Flowers, plants, air and helium balloons, individual orders

An order may be cancelled at the Orderer’s initiative with a refund only within 24 hours from the moment the order is placed and only if delivery or pick-up is not scheduled within the next 3 calendar days.

If delivery or pick-up is scheduled within the next 3 calendar days, the order is considered to be in progress and cannot be cancelled at the Orderer’s initiative with a refund.

Changing the date or time of delivery or pick-up does not restore or extend the Orderer’s right to cancel the order and receive a refund.

If the original delivery or pick-up date fell within the next 3 calendar days, or if at the time of the Orderer’s request there are 3 calendar days or less remaining before delivery or pick-up, the order is considered to be in progress regardless of any subsequent change of date or time.

Such an order cannot be cancelled at the Orderer’s initiative with a refund, except in cases expressly provided for in these terms and conditions or by applicable law.

⚠️ 9. Out of stock and incorrect price

If the ordered product is out of stock or the proposed replacement is not suitable, the order may be cancelled partially or completely.

💶 The refund will be made no later than 14 days from the date of confirmation of cancellation.

The Seller has the right to refuse to fulfil the sales contract or to demand the return of the goods if the price of the goods in the online store was indicated incorrectly and significantly below its market value.

In this case, the Seller shall refund the Buyer the full amount paid within 14 days.

📦 10. Right of withdrawal within 14 days (for applicable goods)

To exercise the 14-day right of withdrawal, the goods must not be used other than to check their nature, characteristics and functionality, to the extent permitted in a physical store.

If there are signs of use, the Seller has the right to reduce the refund amount in proportion to the decrease in the value of the goods.

The Buyer is obliged to return the goods within 14 days from the date of submission of the withdrawal notice or to provide confirmation of the transfer of the goods to the carrier.

The Seller has the right to withhold the refund until the returned goods are received or confirmation of their shipment is provided.

All costs associated with returning the goods shall be borne by the party making the return.

🌿 11. Perishable goods

Perishable goods, including flowers, are non-returnable and have no warranty.

The 14-day right of withdrawal does not apply to such goods.

🎈 12. Air and helium balloons

Inflated balloons:

• no warranty is provided;

• are considered to be of good quality at the time of delivery;

• returns and exchanges are not accepted.

Uninflated balloons in packaging:

• claims are only possible before use if there is a manufacturing defect;

• once inflated, the goods are considered to have been used.

💶 13. Refund fee

In the event of a refund initiated by the Buyer, a fee of 3 euros will be charged to cover bank and administrative costs.

If the refund is initiated by the Seller, the fee will not be charged.

The fee is not a penalty.

🔄 14. Change of delivery/pick-up date or time

Changing the date or time of delivery or pick-up is possible only with the Seller’s consent and is subject to a fee of €3.

The Seller has the right to refuse to change the date or time of delivery or pick-up without giving reasons.

Changing the date or time of delivery or pick-up does not constitute cancellation of the order and does not change the order cancellation and refund terms set out in clause 8 of these terms and conditions.

If the order is already considered to be in progress under clause 8 of these terms and conditions, changing the date or time of delivery or pick-up does not restore the Orderer’s right to cancel the order with a refund.

🎟 15. Coupons

A coupon is a unique code or link that entitles the Buyer to receive a discount or cash equivalent (fixed amount) when placing an order in the ROSES.EE online store under the terms and conditions set by the Seller.

• Can be used once;

• Cannot be exchanged for cash;

• Cannot be combined with other coupons;

• Valid until the date set by the Seller.

All additional fees are always displayed before the order is confirmed.
