Return, delivery, payment

Definitions:

Customer – a natural or legal person purchasing goods from the ROSES.EE online shop.

Recipient – a person to whom the goods will be delivered.

Seller – legal entity ONE Management OÜ, which sells goods on the website roses.ee.

Courier – a person authorised by the ROSES.EE shop to deliver orders.

Delivery:

Made daily from 09:00 to 22:30 throughout Estonia. On public holidays there is a special schedule, details on the ROSES.EE website.

The seller reserves the right to change the delivery time by 60 minutes. When ordering, the delivery time interval is selected and cannot be changed without the seller’s consent.

The courier waits 5 minutes for the recipient and tries to contact by all available means. If the recipient is not available, the courier may transfer the order to a third party if possible. The undelivered order is returned to the pick-up point at Tartu mnt. 24, Tallinn, where it is stored for 24 hours before being disposed of.

A fee of EUR 5 or more will be charged for repeat delivery.

When ordering interval/exact time delivery, the Customer guarantees that the recipient will be at the place during the whole time interval.

It is the responsibility of the customer to provide an accurate delivery address, indicating the correct recipient of the goods, including township, street, house number, name, surname and other information necessary for the correct delivery of the goods. Identification of the recipient shall be made by the courier verbally by asking about the name and surname, without the requirement to present an identity card. In the event of an error in the recipient’s data or if the goods are delivered to the incorrect person, the customer is held fully responsible for such violations. The seller is not liable for the consequences of incorrect identification of the recipient of the goods.

Pick-up points:

Self-collection:

  • Orders can be picked up at Tartu mnt. 24, as well as at other pick-up points throughout Estonia.
  • The recipient is obliged to inspect the goods directly at the pick-up point. If the goods do not meet the stated characteristics, the recipient must refuse to accept them and immediately return them on the spot. Receipt of the order by the customer or the recipient shall be considered as confirmation that the goods have been accepted without any claims against the seller.
  • In case of cancellation of the goods, the money will be refunded within 14 days.

Storage conditions:

  • At all self-checkout points, goods are stored for a maximum of 24 hours.
  • The goods in the points of self-delivery (except for Tartu mnt. 24) are stored without the use of special refrigeration equipment. This may negatively affect the quality and persistence of the flowers.

Payment and orders: Orders are accepted only after 100% prepayment. The basis for order fulfilment is the receipt of money to the seller’s account. Unpaid orders are kept for 2 hours after the specified pickup time, then cancelled.

Seller’s responsibility: Seller is not responsible for errors in the recipient’s contact details if this prevents delivery. The seller is not responsible if the recipient refuses to accept the order, is at a different address or refuses to agree a pick-up time.

Comments to the order are not binding, are of informational nature, are not executed without written agreement of the contractor.

Order cancellation:

The minimum cancellation time is 12 hours. If the order is cancelled less than 12 hours in advance, the money will not be refunded.

If there is no product ordered by the customer or if the replacement product is not suitable, the order is cancelled. The order can be cancelled either partially or completely. The customer is informed about the cancellation of the order during the working day of the shop. In case of partial cancellation, the Seller may ask the Customer’s wishes regarding the execution of the remaining order – to fulfil or also to cancel. In case of cancellation of the order, the amount paid by the Customer shall be refunded as soon as possible, but not later than 14 days from the confirmation of the order cancellation. In order to exercise the right to a 14-day refund, the goods may not be used in any other way than necessary to ascertain the essence, properties and functioning of the goods and than would be permitted for testing in a physical shop. If the goods have been used in a manner other than necessary to ascertain the essence, properties and functioning of the goods, or show signs of use or consumption, the Seller is entitled to reduce the return fee in accordance with the reduction in value of the goods. The Buyer must return the goods within 14 days from the date of submission of the application or provide evidence that he has handed over the goods to the delivery person within the specified period. Upon receipt of the returned goods, the seller shall return to the buyer all fees received on the basis of the contract immediately, not later than 14 days after receipt of the application for cancellation of the goods. The seller may refuse to make the return until

until he has received the item agreed in the contract or until the buyer provides proof that he has sent the item back – it depends on what happens first. If the Buyer has clearly chosen a delivery method other than the cheapest one offered by the Seller, the Seller is not obliged to reimburse the Customer for the costs exceeding the costs of the usual delivery method. The Seller has the right to withdraw from the sale transaction or request the Customer to return the goods if the price of the goods in the online shop has been erroneously indicated significantly lower than their market value. The Seller has the right to cancel the order, if necessary, returning the entire amount paid to the Customer at any time.

The right to a refund:

In accordance with the Consumer Protection Act of the Republic of Estonia (26.04.12, No. 1-1 / 12-019), no warranty or right of return applies to perishable goods, including flowers. The 14-day right of cancellation does not apply to goods (Act § 53 lg 4) prepared for the individual needs of the purchaser and on the purchaser’s own conditions (according to the consumer’s criteria), which are perishable products.
