Definitions:
Customer – a natural or legal person who buys goods from the ROSES.EE online shop.
Subscriber – a person who has accepted the payment terms and conditions, who has placed and paid for the order on the ROSES.EE website.
Consignee – a person to whom the goods are delivered.
Seller – legal entity ONE Management OÜ, which sells goods on the ROSES.EE website. Courier – a person authorised by ROSES.EE shop to deliver orders.
Delivery: Every day from 09:00 to 22:30 throughout Estonia. The seller has the right to set a different delivery schedule at his discretion, without notifying the buyer in advance, more detailed information is available on the ROSES.EE website.
The seller reserves the right to change the delivery time up to 60 minutes. The delivery time slot is selected at checkout and cannot be changed without the seller’s consent. The courier waits for the recipient for 5 minutes and tries to contact by all possible means. If the recipient is unavailable, the courier may transfer the order to a third party if possible. Undelivered orders are returned to the self-service point located at 24 Tartu Highway, Tallinn, where they are stored for 24 hours before being destroyed. Notification of an undelivered order is sent to the Buyer’s e-mail address, which was specified when placing the order. Seller does not guarantee delivery of this message. A fee of €5 or more will be charged for redelivery.
By ordering interval or exact time delivery, the Customer guarantees the presence of the recipient during the entire selected time period.
The Customer is solely responsible for providing the correct delivery address, including the correct recipient, including town, street, house number, first and last name, as well as other information necessary for correct delivery.
The courier identifies the recipient verbally, specifying the first and last name, without requiring an identity document. In case of errors in the recipient’s data or transfer of goods to the wrong person, the customer bears full responsibility for such violations.
The seller is not responsible for any consequences resulting from incorrect identification of the recipient of the goods.
Delivery points: Self-delivery: Orders can be picked up at Tartu Highway 24, as well as at other delivery points throughout Estonia. The seller reserves the right to change the delivery time without notifying the buyer, but not more than 60 minutes.
The recipient is obliged to check the goods on the spot at the self-service point. If the goods do not meet the stated characteristics, the recipient must refuse to accept the goods and immediately return them to the same place.
Receipt of the order by the buyer or the recipient is considered as confirmation of receipt of the goods without any claims against the seller.
In case of returning the goods, the funds will be refunded within 14 days.
Storage conditions: At all pick-up points goods are stored for a maximum of 24 hours.
Goods at pick-up points (except for Tartu Highway 24) are stored without special refrigeration equipment. This may affect the quality and longevity of the flowers.
Payment and orders: Orders are accepted only by 100% prepayment. Order fulfilment is based on payment received into the seller’s account. Unpaid orders will be held for 2 hours after the stated time of receipt and then cancelled.
Seller’s responsibility: Seller is not responsible for errors in the recipient’s contact details if they prevent delivery of the goods. The seller is not responsible even if the recipient refuses to accept the order, is at a different address or does not wish to agree on a delivery time.
Comments on the order are not binding, but are for information purposes only and will not be executed without the seller’s written consent.
Order Cancellation: Flowers, Fruit, Balloons: A) Refunds are available from the time of order placement and within 24 hours of order placement, less bank charges (if any). If the order is placed less than 24 hours before the delivery or pick-up time, cancellation and refunds are not possible (see rule C).
B) If more than 24 hours have passed since the order was placed and at least 24 hours remain until the order is fulfilled, it is possible to receive a refund in the form of a coupon for the amount of the order. The coupon is valid for 3 months.
C) No refund will be given less than 24 hours before the order is fulfilled. In case of Karu courier service and addresses more than 10 km away from Tartu Highway 24, Tallinn, cancellation is possible 12 hours before the delivery time.
If the ordered item is out of stock or the replacement item is not suitable, the order will be cancelled. The order can be cancelled either partially or completely. The buyer is obliged to notify the shop about the cancellation of the order within a working day. In the case of partial cancellation, the seller may request the customer’s recommendation regarding the rest of the order – to carry it out or also to cancel it. In case of cancellation, the amount paid will be refunded to the customer as soon as possible, but no later than within 14 days of confirmation of the cancellation.
To exercise the 14-day right of return, the product must not have been used in any way other than to test its nature, features and performance, which is allowed for testing in a physical shop. If the product has been otherwise used or shows signs of use or wear and tear, the seller has the right to reduce the refund amount commensurate with the reduction in the value of the product.
The buyer must return the goods within 14 days of submitting a cancellation request or provide proof that they have handed over the goods to the vendor within the specified period. The seller will immediately refund all contractual fees to the buyer, but no later than within 14 days of receipt of the application for cancellation. The seller may refuse the refund until he has received the returned goods according to the contract or until the buyer has provided proof of the returned goods, whichever occurs first. If the buyer has explicitly chosen a delivery method other than the cheapest delivery method offered by the seller, the seller is not obliged to compensate for costs in excess of the normal delivery costs. The seller has the right to withdraw from the sale transaction or demand the return of the goods if the price of the goods in the online shop has been erroneously marked as significantly lower than their market value. If necessary, the seller has the right to cancel the order and return the entire amount received from the buyer at any time. Other goods, such as flower scissors, can be returned within 14 days in accordance with Estonian law. Right of Return: According to the Consumer Protection Act of the Republic of Estonia (26.04.12, No. 1-1/12-019), perishable goods, including flowers, are not covered by any warranty or right of return. The right of refusal within 14 days does not apply to products (Act § 53 (4)) that are made according to the buyer’s individual needs or the conditions presented by the buyer (in accordance with the consumer’s criteria) and are perishable.
